Terms and Conditions
The founder of Delta Agile, Denis Curk s.p., based in Grosuplje (hereinafter Delta Agile or the provider), adopts the following act on November 2, 2023.
Definition of Terms
The terms used in these general conditions have the following meanings:
- Course, workshop, education, presentation workshop, consulting, training, mentoring, and other forms of education and consulting – refers to any service provision by Delta Agile for individuals or groups of one or more clients (hereinafter events, courses, education, or services).
- Business agreement means an agreement with a written, electronic, or verbal offer issued by the company and accepted by the client (legal or natural person) in verbal or written form (including by email) or registration through the website as well as implicitly by arranging details regarding the event execution (hereinafter business agreement).
- A party to these terms and conditions is any natural or legal person who has entered into a business agreement, regardless of whether the participant is also the service payer (hereinafter party).
- Participant is any user who attends training or uses any other services provided by Delta Agile.

The Terms and Conditions govern the operation of the website www.deltaagile.com, the rights and obligations of users, and regulate the business relationship between the provider and the client.
The Terms and Conditions govern all relationships between stakeholders, regardless of the method and location of service delivery.
Users are bound by the Terms and Conditions valid at the time of business agreement.
General
By signing the contract, submitting a purchase order, registering for an event via email, website, or confirming engagement implicitly by arranging execution dates and other details in writing (by email or otherwise), the client confirms:
- that they have read the order details, price, payment terms, and terms of business and agree with them;
- that they are aware that the provider processes the above personal data:
- for the purpose of providing the service that is the subject of the order, maintaining records of event participants, and contacting them by email or phone regarding registration, course progress, content and satisfaction, sending materials related to the event, and informing about planned events;
- will not transfer it to a third country or international organization and;
- will store it for a period of 10 years after the service that is the subject of the business agreement;
- that they are aware that the provider ensures the following rights regarding personal data protection: right of access to data, right to correction, right to erasure (“right to be forgotten”), right to restriction of processing, right to data portability, right to object.

The provider is not liable to the client for non-functioning or poor functioning of services if they result from factors beyond their control (internet connection interruption at the user’s end, computer malfunction, etc.).
Provider's Services
The provider issuing the general terms of service use, price lists, handling complaints and other procedures with service users guarantees the provision of services, the content of the service itself and their prices. Security of service use on the provider’s side is ensured through appropriate technical solutions, rules, processes, general terms and the agreement concluded between the client and provider. Ensuring safe use on the client’s side is in their domain and does not bind the provider to any responsibility.
Delta Agile offers online training courses and business consulting, which can be conducted online, at the client’s location, or at a third location.
Training is conducted through the GoToWebinar online platform, which enables screen sharing, including presentation slides, software demonstrations, video playback, photos, etc., voice and video transmission of the instructor, and voice and video transmission of participants. The online platform also enables sharing materials in the form of files and web chat.
Each training is conducted based on an appropriate number of registered participants. The minimum number of registrations required for training execution is 4; exceptionally, the provider may conduct training with fewer participants but is not obligated to do so.
The user does not acquire ownership, copyright, or related rights to content provided by the provider or other contractual partners of the provider. The provider is in no case liable for any claims by third parties due to violations by users that violate ownership, copyright, related and other rights of the provider’s contractual partners or third parties.
Validity of Terms and Conditions
The company’s Terms and Conditions (hereinafter Terms and Conditions) apply to all events and services organized and provided by the provider and to receiving free e-newsletters.
The Terms and Conditions apply and are used equally for all events and participants unless otherwise specified by the provider within the registration for a particular event or service.
The Terms and Conditions are an integral part of every registration/order for any service, regardless of the form of registration (via email, physical order form, e-registration, or by phone).
A person who registers for an event commits to having read the event details and Terms and Conditions and agrees with them.
A person who subscribes to e-newsletters commits to having read the Terms and Conditions and agrees with them.
Subscription and Unsubscription to Free E-newsletters
By subscribing to e-newsletters, the individual agrees to receive regular (once to twice yearly) e-newsletters to their email address, containing:
- articles on Agile approach topics;
- current service offerings from the provider and partners;
- announcements of various events related to the provider and partners.
Unsubscription from free e-newsletters is possible:
- by clicking the unsubscribe button at the bottom of each e-newsletter or
- in writing to the email address info@deltaagile.com.
Registration for Paid Events and Payment of Invoice/Fee
By signing the order form/contract/confirming the execution of the event or events via email or implicitly by agreeing to the date of event execution, the client commits to having read the order details and terms of business and agrees with them.
By concluding the business agreement, the client commits to paying the price for ordered and performed services of the provider within 8 days, unless otherwise agreed in the offer, pro-forma invoice, or contract.
An exception is registration through the website where the client chooses payment via PayPal system or credit card. In this case, payment is executed immediately.
Completing the registration form for a service through the website represents explicit and irrevocable consent to participate in the event or service execution. By registering, each participant or their payer (if different from the participant) commits to paying the full fee for participation in the training under the conditions in this document or in the offer for individual training. This also applies to events and consultations in sets when the participant stops attending training at any time after the service begins. An exception is the Quality Guarantee, which allows for full refund of the current course if the client is not satisfied and leaves the course after no more than the first day of a multi-day course.
At the moment of registration, the provider is entitled to issue a pro-forma invoice. The payment deadline is 8 days after service delivery, except when the client has registered for the service through the online form and selected PayPal or credit card as the payment method. In this case, payment is executed immediately, and the invoice is sent by email no later than the next business day.
The business agreement between Delta Agile and the client is finally concluded when Delta Agile sends the client their first email about the status of their order (with the subject: “Thank you for registering for training” or “Thank you for purchasing consulting services”). From this moment, all conditions are set and apply to both the provider and the client. The client or customer is considered to be the person with the data as stated during registration.
A user who would register for courses without their company’s permission is liable for damages in accordance with applicable legislation.
Payment Methods
Delta Agile enables the following payment methods:
- By transfer to Delta Agile, Denis Curk s.p.’s current account according to the offer or pro-forma invoice received to your email address.
- By paying the invoice received to your email address.
- Payment after course completion is possible exclusively for legal entities.
- Services via PayPal system or credit card when ordering through the website.
In case of order cancellation or change of payment method by the client, they must notify the provider at the email address info@deltaagile.com.
Invoice Issuance
Upon payment for services, the provider sends the client an invoice in Adobe Reader (.pdf) format to the client’s email address.
The invoice itemizes the price and costs related to the purchase and includes notice of the right to withdraw from the contract. Delta Agile is not subject to VAT, therefore service prices do not include VAT.
The buyer is obliged to verify the accuracy of data before submitting the order. Later objections regarding the accuracy of issued invoices will not be considered.
Settlement of Obligations and Non-payment
In case of unsettled obligations by the client, additional reminder costs and late payment interest may be charged according to applicable legislation.
The client is obliged to verify whether they have received Delta Agile’s invoice to their email and in all folders therein. It is also the client’s duty to notify the provider of any errors on the invoice via email at info@deltaagile.com. It is the client’s responsibility to pay their obligations for which they have concluded the business agreement.
Training Cancellation Terms
You can cancel your participation in writing no later than 10 days before the training starts. After this date, we charge 30% of the fee for administrative costs. For non-attendance without cancellation, we charge the full training fee. The fee is one-time transferable to other dates, other training programs, or other persons with explicit consent from Delta Agile. Exceptionally, we may acknowledge a reduction in fee due to non-attendance in case of illness or accident of the participant or their immediate family member. Such training cancellation must be in writing. In this case, we only charge for materials and their shipping costs, and a proportional share of hours of training already completed, from the start until the justified cancellation of participation.
Cancellation of Training by Delta Agile
In case of insufficient registrations or other objective reasons, we reserve the right to cancel individual training or change dates, no later than three working days before the training starts. In case of training cancellation by Delta Agile, any already paid fee will be refunded without interest within 10 days of the cancellation notice.
Complaints and Dispute Resolution
The user has the right and opportunity to express their complaints, reclamation, or disagreement regarding the provider’s services using any communication means available or published on deltaagile.com website.
The user can choose the method and means by which to communicate their complaint or reclamation.
The procedure for handling complaints or reclamations that Delta Agile recommends to users is as follows:
- Complaints or reclamations can be communicated via email to info@deltaagile.com
- Within 8 days, the provider is obliged to respond to the client’s complaint or reclamation, if it is justified, and how it will be resolved.
A complaint can be submitted during the course of training or consulting.
Personal Data Protection
In our company, we are aware of the responsibility of handling personal data, therefore we manage, maintain, store, and control all personal data collections in accordance with the current Personal Data Protection Act and enable personal data subjects whose data we process to:
- Unsubscribe from e-newsletters by clicking the unsubscribe option on individual e-newsletters or by submitting a request to info@deltaagile.com.
- Withdraw consent for telephone or electronic communication by submitting a request to info@deltaagile.com.
- Correct their personal data by submitting a request to info@deltaagile.com.
- Export and view their personal data from the company’s notification database by submitting a request to info@deltaagile.com.
- Permanently delete their personal data from the company’s notification database by submitting a request to info@deltaagile.com.

Validity of Terms and Conditions
